Labour Market Opinions (LMOs) are approvals by the Government of Canada for an employer to hire foreign worker/s. Many foreign workers believe that they are given a Labour Market Opinion (LMO) to be able to work in Canada. This however is erroneous. The Canadian employer applies for the Labour Market Opinion (LMO) for a certain number of positions. Most provinces allow you to apply for an unnamed Labour Market Opinion (LMO). Only the number of positions is specified. Once the employer has prospective employee or employees identified they then asks for Service Canada to add the name or names of the employees onto the Labour Market Opinion (LMO). At no point is the Labour Market Opinion (LMO) property of the employee. The LMO cannot be applied for or obtained by the employee as it must be applied for by the employer.
The employer must show that they have made efforts to recruit, and the willingness to train Canadian permanent residents or citizens. The employer must pay the average wage as stipulated by Service Canada for the NOC code and region where the job is being offered. Also, the working conditions have to meet the provincial labour market standards. Once the employer receives a positive LMO they will need to send a copy to the foreign worker they wish to hire so that they can submit the LMO copy with their application for a work permit.
Many employers believe that the Canadian government has stopped approving LMOs completely. While some provinces may be more difficult to get LMOs approved, Service Canada is still approving when all of their requirements are met. Labour Market Opinions (LMOs) in Alberta, British Columbia and Saskatchewan have been regularly approved this year. LMOs in Ontario and Manitoba are among the more difficult provinces for Labour Market Opinion (LMO) approval.
